These Terms of Service ("Terms") govern your access to and use of the services provided by BrainBestLifeLab Ltd., a company established under the laws of the Republic of Uzbekistan ("we", "us", "our"). Our platform pairs Uzbekistan's natural landscapes with guided mindfulness and brain-friendly digital wellbeing tools. By using our services you agree to these Terms.
1. Eligibility and Accounts
Users must be at least 16 years old. If you are under 18 you may use the Services only with permission from a parent or legal guardian. You agree to provide accurate registration information and to keep your account credentials secure. You are responsible for activity that occurs under your account and for promptly notifying [email protected] of any unauthorized use. We may suspend or terminate accounts that violate these Terms or applicable law.
2. User Content, Community, and Conduct
You retain ownership of content you post, including forum messages, photos, and reviews. By posting content you grant BrainBestLifeLab a worldwide, non-exclusive, royalty-free license to host, use, display, reproduce, and distribute that content to provide the Services. You represent that you have the rights to post your content and that it does not violate others' rights. Community features are moderated and users must not post abusive, illegal, or infringing material. We reserve the right to remove content that violates rules and to suspend repeat offenders.
3. Intellectual Property
All platform design, text, graphics, software, and trademarks (excluding User Content) are the intellectual property of BrainBestLifeLab or our licensors. You may not copy, modify, distribute, sell, or lease any part of our Services without prior written permission. Where you are granted limited access (for example, to use guided sessions or download permitted materials), such access is revocable and does not transfer ownership.
4. Health, Safety, and No Medical Advice
Our content, including brainwave analytics, nature immersion guides, and wellbeing recommendations, is educational and intended to support digital wellbeing and mindfulness. It is not medical advice. Do not rely on the Services for diagnosis or treatment. If you have health concerns, seek professional medical advice. Users engaging in outdoor activities must take precautions for their safety; we are not responsible for physical injuries, accidents, or losses that occur during wellness activities or while following trail guidance.
5. Limits of Liability and Disclaimers
To the maximum extent permitted by law, BrainBestLifeLab provides the Services "as is" and disclaims all warranties, express or implied. We do not guarantee uninterrupted or error-free operation. We are not liable for indirect, incidental, special, or consequential damages, lost profits, or loss of data. Our aggregate liability for direct damages shall not exceed the amount paid by you to us in the six months preceding the claim, or fifty US dollars if no payment was made. Some jurisdictions do not allow certain limitations on liability, so those limitations may not apply to you.
6. Indemnity
You agree to indemnify and hold BrainBestLifeLab, its officers, directors, employees, and agents harmless from claims, damages, losses, and expenses arising from your breach of these Terms, your misuse of the Services, or your violation of third-party rights.
7. Privacy and Data Protection
Our Privacy Policy (available at /privacy/) describes how we collect and process personal data, including wellness telemetry, GPS trail logs, and community content. EEA users have GDPR rights such as access, rectification, erasure, restriction, objection, and portability. By using the Services you consent to the processing described in the Privacy Policy and to any cross-border transfers performed under applicable safeguards.
8. Termination and Suspension
We may suspend or terminate accounts and access for violations of these Terms, suspected fraud, legal requests, or security concerns. Termination does not relieve you of obligations incurred prior to termination. When accounts are closed we will manage your data in accordance with our Privacy Policy and applicable law, including requests for erasure where permitted.
9. Modifications to the Services and Terms
We may update or modify the Services and these Terms. Material changes will be communicated via the platform or email when feasible. Continued use after changes indicates acceptance of the updated Terms. If you disagree with a change, you should stop using the Services and may request account closure following the process in the Privacy Policy.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Uzbekistan. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Uzbekistan. For EEA users, certain mandatory rights under local law may apply; nothing in these Terms limits those mandatory protections where applicable.
